Welcome to TravPair! These Terms of Service ("Terms") govern your access to and use of TravPair's website, applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

2. Eligibility

To use TravPair, you must:

• Be at least 13 years old (or 16 in the EU)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using our Services under applicable laws
• Provide accurate and complete registration information

If you are under 18, you represent that you have your parent or guardian's permission to use the Services.

3. Account Registration and Security

Creating an Account

To access certain features, you must create an account. You agree to:

• Notify us immediately of any unauthorized use of your account

4. Acceptable Use Policy

5. User Content and Intellectual Property

You retain ownership of any content you create or upload to TravPair ("User Content"), including trip plans, photos, and comments.

By uploading User Content, you grant TravPair a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of operating and improving the Services.

Content Standards

All User Content must:

• Be accurate and not misleading
• Not infringe on any third party rights
• Not contain illegal, offensive, or harmful material
• Comply with applicable laws and regulations

TravPair's Intellectual Property

The Services, including all software, text, images, and logos, are owned by TravPair and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without prior written permission.

6. Payments and Subscriptions

Paid Services

TravPair offers both free and paid subscription tiers. Paid subscriptions are billed on a recurring basis (monthly or annually) unless canceled.

Payment Processing

All payments are processed through Stripe. By subscribing to a paid plan, you agree to Stripe's Terms of Service and authorize recurring charges to your payment method.

Refunds and Cancellations

• You may cancel your subscription at any time
• Upon cancellation, you will retain access until the end of your billing period
• We do not offer refunds for partial billing periods
• Failed payments may result in suspension of your account

Price Changes

We reserve the right to change our pricing. We will notify you at least 30 days in advance of any price changes. Your continued use of the Services after the price change constitutes acceptance of the new price.

7. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using TravPair, you consent to our data practices as described in the Privacy Policy.

8. Third-Party Services

TravPair integrates with third-party services (e.g., Google Maps, Stripe, OpenWeatherMap). Your use of these services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or content of third-party services.

9. Disclaimers and Limitations

Service "As Is"

TravPair is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or secure.

Travel Information

TravPair is a planning tool. We do not guarantee the accuracy, completeness, or reliability of any travel information, recommendations, or third-party content. Always verify travel details independently before making bookings or travel decisions.

10. Limitation of Liability

To the maximum extent permitted by law, TravPair shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Services
• Any unauthorized access to or use of our servers or your personal information
• Any interruption or cessation of transmission to or from the Services
• Any bugs, viruses, or other harmful code transmitted through the Services
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content

Our total liability to you for all claims arising from or related to the Services shall not exceed the greater of £100 or the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless TravPair, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your User Content

12. Dispute Resolution

Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@travpair.com. We will try to resolve the dispute informally within 60 days.

Jurisdiction and Legal Proceedings

If we cannot resolve the dispute informally, any legal proceedings will be subject to the exclusive jurisdiction of the courts of England and Wales. You agree to submit to the personal jurisdiction of these courts.

Exceptions

Either party may seek equitable relief in court to protect intellectual property rights or prevent ongoing harm.

13. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Services will immediately cease
• We may delete your account and User Content
• You will remain liable for any outstanding payments

You may terminate your account at any time by contacting us or using the account settings.

14. General Provisions

Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions.

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and TravPair regarding the Services.

Severability

If any provision of these Terms is found to be unenforceable, that provision will be removed and the remaining provisions will remain in full effect.

Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
